Put unbiased persons with an economic background in charge of patent system governance and let them review the institutional incentives. Get rid of 'technical judges' without legal competence and eligibility to a judicial office and their 'case law' undermining the work of professional judges. Prevent patent offices from lobbying the legislator and take sides in a legislative debate. Give full freedom of speech to patent examiners and allow them to fully participate in public debates.

Patent professionals as industry advocates for software patenting

The alleged support of some large corporations for software patents does not follow an observable interest calcule of these enterprises but is based on the fact that patent policy issues are usually discussed in circles where patent attorneys speak in the name of their company. An those forward the belief system of their profession or their peer group as the interest of their company.
